ether.fi Cash Cashback Rewards Program (U.S. and International)

These Cashback Rewards Program Terms and Conditions ("Terms") govern the Cashback Rewards Program (the "Cashback Program") that is part of your Account ("Card Account"). The Cashback Program is offered by Ether.Fi Cash Ltd ("Provider") and is subject to these Terms.
These Terms supplement your Ether.Fi Cash Ltd Cardholder Agreement with the Provider and together constitute the entire agreement between you and Provider regarding the Cashback Program. Issuer of your card does not have any affiliation with the Cashback Program. Use of your Card Account constitutes your acceptance of these Terms. In the event of any conflict between these Terms and the Ether.Fi Cash US Card Agreement, the Ether.Fi Cash International Card Agreement, or the Ether.Fi Cash Corporate Card Agreement (βthe Applicable Card Agreement), the Applicable Card Agreement shall govern except for matters specifically related to the Cashback Program, in which case these Terms shall govern.
All capitalized terms not defined herein shall have the meaning set forth in the Ether.Fi Cash Ltd Cardholder Agreement.
ELIGIBILITY
To be eligible to earn Cashback Rewards via the Cashback Program, you must have an active Card and maintain your Card Account in good standing in accordance with the terms of your Card Agreement. Provider may, in its sole discretion, determine whether your Card Account is in good standing for purposes of the Cashback Program.
CASHBACK REWARDS EARNING
a. Qualifying Transactions: You will earn 2% Cashback Rewards on eligible purchases if you are a Tier 1 user, and 3% Cashback Rewards if you are a Tier 2 or Tier 3 user, for purchases of goods and services made for personal, family, or household purposes using your Card Account, minus any returns, refunds, or credit adjustments (βQualifying Transactionsβ).
b. Excluded Transactions: The following transactions are not Qualifying Transactions and do not earn Cashback Rewards: ATM withdrawals, peer-to-peer payments (such as, by way of example, Apple Pay Cash or Google Pay), currency exchange service providers, tax payments, person-to-person transfers, the purchase of gift cards and the purchase of money orders or other cash equivalents, even if used to purchase goods or services.
c. Beginning to Earn: You begin earning Cashback Rewards when you open a Card Account, activate your Card, and begin making Qualifying Transactions.
d. Provider Discretion: Provider reserves the right, at its sole discretion, to grant Cashback Rewards via the Program even if you did not make a Qualifying Transaction.
e. Cashback Rewards: You will earn Cashback Rewards in the form of Scroll tokens (or other digital assets as determined by Ether.fi in its sole discretion) on Qualifying Transactions. The USD value of the Cashback Rewards will be determined at the time of distribution using on-chain price oracles or other reliable pricing data sources available to Ether.fi in its sole discretion. Ether.fi reserves the right to change the reward token type, pricing methodology, or payout frequency in its sole discretion, and will notify users in the event of such changes.
CASHBACK REWARDS TRACKING AND REDEMPTION
a. Rewards Tracking: The Cashback Rewards you have earned will be shown when you login to your account online. This will show your monthly Cashback Rewards earned and deposited to your Card Account.
b. Rewards Availability: Cashback Rewards will be made available instantly upon the completion of each Qualifying Transaction. Pending transactions do not earn Cashback Rewards until they are fully processed.
c. Rewards Receipt: As long as your Card Account is open and in good standing and you are not in violation of the Card Agreement, after the Cashback Rewards have been made available as described in Section 3(b) above, the amounts earned will be reflected in your Card Account balance.
d. Reversals: Cashback Rewards paid in previous months may be reversed through a corresponding debit to your Card Account or through a reduction in the current month's benefit if a transaction on which a cashback payment was paid is reversed through a merchant credit.
e. Statement Date Processing: Cashback Rewards are calculated based on eligible purchases appearing on your statement for a given month. We'll then add the cashback amount to your account on your statement date for the following month.
REWARDS ERRORS AND DISPUTES
a. Error Reporting: It is your responsibility to notify Provider in the event you do not receive your Cashback Rewards or believe there is an error. If your Cashback Rewards have not posted correctly or for further details, please contact Customer Service at support@ether.fi.
b. Time to Report: You must notify Provider of any suspected errors in the Cashback Program within sixty (60) days of the date of the statement on which the suspected error appeared.
c. Investigation: Provider will investigate any reported errors and will correct any errors that Provider confirms within a reasonable time.
TAX IMPLICATIONS
You understand that you are responsible for determining and obtaining appropriate tax treatment for any Cashback Rewards you redeem, and you are solely responsible for any tax liability arising from or related to any earned Cashback Rewards. Provider will not report any income or earnings related to Cashback Rewards to a taxing authority, except where expressly required by law.
ACCOUNT STANDING
If your Card Account is not in good standing (for example, if your Card Account is overdrawn) or you are otherwise in violation of the Card Agreement, Provider reserves the right to apply the value of your Cashback Rewards to offset any outstanding overdraft in your Card Account.
RELATED ACCOUNTS
a. Required Accounts: Depending on your region, you may be required to maintain a personal current account with us to earn cashback on your Card Account.
b. Closing Related Accounts: If we see that you've closed your required current account, we'll contact you and give you 60 days to open another one before we stop your cashback. If you don't open another required account within 60 days, we'll stop your cashback. If you open a required account after the 60-day period, your cashback eligibility will not automatically be reinstated.
FRAUD AND PROGRAM MISUSE
a. Prohibited Conduct: In Provider's sole discretion, Provider may prohibit you from earning Cashback Rewards or using Cashback Rewards you have already earned if: i. Provider suspects that you have engaged in fraudulent activity related to your Card Account or the Cashback Program; or ii. Provider suspects that you have misused the Cashback Program in any way, including but not limited to engaging in excessive refunds associated with purchases for the purposes of generating Cashback Rewards.
b. Duration: This suspension may be temporary or permanent at Provider's sole discretion.
c. Transaction Disqualification: Provider reserves the right to disqualify transactions not usual, customary, or, in Provider's sole discretion, structured or intended to abuse the Cashback Program. This could include, for example, but not limited to, small dollar transactions conducted on the same day at a single merchant (or multiple transactions in a short period of time). Abuse of the Cashback Program may result in the Card Account being suspended or closed.
d. Rewards Forfeiture: Provider reserves the right to forfeit your Cashback Rewards if you close your Card Account.
e. Card Loss or Theft: If your Card Account is suspended or closed due to your Ether.Fi card being lost or stolen, you will not lose the cashback you've earned but hasn't been added to your account yet.
PROGRAM CHANGES AND TERMINATION
a. Program Modifications: Provider may modify the Cashback Program, including, without limitation, the rate of Cashback Rewards earnings, the types of Qualifying Transactions, the Cashback Rewards cap, the method by which Cashback Rewards are calculated, how Cashback Rewards are earned and/or redeemed, and any maximum or minimum Cashback Rewards amounts you can earn, at any time. We'll give you at least 30 days' notice if we're going to do this. But if the change is to your advantage, we might make the change immediately and tell you about it within 30 days after we make the change.
b. Program Termination: Provider may terminate the Cashback Program at any time. If the Card Agreement is terminated, these Terms will also immediately terminate.
c. Notice: Provider may update these Terms with at least 30 days' notice to you by posting an updated version of these Terms at any time. We'll do this by post, email, on your statement, or as an eDocument you can see in Online. Continued participation in the Cashback Program after any change constitutes your agreement to be bound by any such changes.
d. Termination Effects: If the Cashback Program is terminated, all Cashback Rewards that have not been credited to your Card Account at the time of termination may be forfeited.
BY USING YOUR CARD, YOU AGREE TO ALL OF THE TERMS AND CONDITIONS OF THIS AGREEMENT.
